A Question we get in our office often is what to do if a tree falls across property lines. It's a common occurrence so here's the scoop. If your neighbor's tree falls on your property and it is a healthy tree, it is considered an act of God and the damage will be paid by your insurance, not theirs. If the neighbor has a dead or diseased tree please notify them in writing to get the tree removed as soon as you notice. Some insurance companies require you to notify the neighbor of their dead tree prior to anything happening. If they don’t remove it and it falls onto your property, you should be able to collect from their policy as they are liable for any damages and cleanup.
